The Committee secretariat informed that, according to the working group, there is an urgent need to clearly specify functions against economic crimes and other related functions performed by law enforcement bodies and to take respective organization and legal measures.
To strengthen fight against economic crimes there is a need to depoliticize the activities of law enforcement bodies which will allow for strengthening procedural independence of investigative units engaged in combating economic crimes.
The members of the working group consider it urgent to improve the structure and functioning of the bodies responsible for the control over adherence to legislation in the sphere of economic activity and conduct investigative activities and prejudicial inquiry of crimes in this sphere.
The Recommendations stress that the main defaults of the current system are: the diffusion of forces and means; duplication of powers; complication of interaction between different bodies of executive authority performing law enforcement functions; as well as large number of administrative personnel and costs for its maintenance.
To solve these problems the working group recommends concentrating efforts, in order to combat these crimes, in a single structure established on the basis of tax police and the relevant departments of the Ministry of Internal Affairs. It should be the central body of executive authority responsible for combating economic crimes. The activities of such body will be directed and coordinated by the Ministry of Internal Affairs being transfered the authorities of all other state bodies related to the sphere of economic crimes.
The establishment of such body will promote favorable conditions for the development of entrepreneur activity; minimize shadow economy; improve methods of identifying and collecting information connected with economic crimes, etc.
The Committee agreed to study the issue regarding establishment of the central executive body to combat economic crimes and if necessary, according to article 12 of the Law "On the Committees of the Verkhovna Rada of Ukraine" to prepare the respective bill.
